1. Introduction

Welcome to FoodSaver ("we," "our," or "us"). These Terms and Conditions ("Terms") govern your use of the FoodSaver platform (the "Platform"), which connects food businesses with customers to reduce food waste by selling surplus food at discounted prices.

By accessing or using our Platform, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the Platform.

2. Definitions

• "Customer" means a user who purchases food items through the Platform.
• "Business" or "Vendor" means a food business that lists surplus food items for sale on the Platform.
• "Listing" means a food item offered for sale on the Platform.
• "Order" means a purchase made by a Customer of a Listing from a Business.
• "Platform" means the FoodSaver website and mobile application.

3. Eligibility

To use the Platform, you must:

• Be at least 18 years old
• Have the legal capacity to enter into binding agreements
• Provide accurate and complete information when registering
• Maintain the security of your account credentials

4. Account Registration

To access certain features of the Platform, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your account information as necessary
• Maintain the security of your password
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use of your account

5. Business Verification

Businesses must undergo verification before listing food items. This includes:

• UK Companies House registration verification
• Submission of required business documents
• Approval by FoodSaver administrators

We reserve the right to reject or suspend business accounts that do not meet our verification requirements.

6. Food Listings

Businesses listing food items agree to:

• Provide accurate descriptions and pricing
• Ensure food items comply with UK food safety regulations
• Maintain accurate inventory counts
• Clearly display expiry dates and collection/pickup times
• Handle food in accordance with food safety standards

7. Purchases and Payments

All purchases are processed through Stripe. By making a purchase, you agree to:

• Pay the listed price plus any applicable delivery fees
• Provide accurate payment information
• Authorize payment processing through our payment provider
• Accept that all sales are final unless otherwise stated

Prices are displayed in GBP (£) and include VAT where applicable. Delivery fees are calculated separately and clearly displayed during checkout.

8. Refunds and Cancellations

Refund policies:

• Customers may cancel orders before payment confirmation
• Refunds may be available if food items are not as described or are unsafe
• Refund requests must be submitted within 24 hours of collection/delivery
• Refunds are processed at the discretion of the Business and FoodSaver

9. Food Safety and Liability

FoodSaver acts as a platform connecting Businesses and Customers. We do not:

• Handle, store, or prepare food items
• Guarantee the quality, safety, or freshness of food items
• Accept liability for food-related illnesses or allergic reactions

Customers are responsible for:

• Checking food items upon collection/delivery
• Handling and storing food items properly
• Being aware of allergens and food safety considerations

10. Platform Fees

FoodSaver charges a platform fee on transactions. This fee is deducted from payments to Businesses. The current platform fee percentage is displayed during business registration and may be updated with notice.

11. User Conduct

You agree not to:

• Use the Platform for any illegal or unauthorized purpose
• Violate any laws or regulations
• Interfere with or disrupt the Platform
• Attempt to gain unauthorized access to any part of the Platform
• Transmit any viruses, malware, or harmful code
• Use the Platform to harass, abuse, or harm others

12. Intellectual Property

The Platform and its content, including logos, designs, and text, are owned by FoodSaver and protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without our permission.

13. Termination

We reserve the right to suspend or terminate your account at any time for violations of these Terms or for any other reason we deem necessary. You may terminate your account at any time by contacting us.

14. Disclaimers

The Platform is provided "as is" without warranties of any kind. We do not guarantee that the Platform will be available at all times or free from errors. We are not responsible for any losses or damages resulting from your use of the Platform.

15. Limitation of Liability

To the maximum extent permitted by law, FoodSaver shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.

16. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

17. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes via email or through the Platform. Continued use of the Platform after changes constitutes acceptance of the modified Terms.
